The MTPL policyholder (at-fault party) must:
a) Take all possible actions to minimize the damage caused.
b) Notify the police or other legal authorities about the accident (except for accidents eligible for documentation via the amicable accident reporting procedure) immediately after its occurrence.
c) If using the amicable accident reporting procedure:
– immediately notify the MTPL insurer that issued the mandatory MTPL insurance policy or the BNAA (for Green Card insurance holders) about the accident on the territory of the Republic of Moldova;
– document the circumstances of the accident by filling out and signing the "Amicable Accident Report Form" with the other driver involved;
– record witnesses’ details if available;
– take photos and/or videos at the scene of the accident that include both damaged vehicles, their license plates, visible damage, skid marks, and debris, if present;
– submit the completed and signed copy of the "Amicable Accident Report Form" to the MTPL insurer within two business days;
d) Notify the MTPL insurer or BNAA about the accident within 48 hours.
e) Inform the other parties involved and the injured party or their representatives about holding an MTPL insurance policy and/or Green Card insurance and provide necessary information about the insurer.
f) Present to the MTPL insurer the accident report prepared by the police, a valid driver’s license, vehicle registration certificate, and the vehicle’s valid periodic technical inspection report.
g) Provide access to the vehicle involved in the accident upon the insurer's request.
In the event of a vehicle accident, the injured party must undertake the following actions:
Request from the policyholder (at-fault party) the necessary information for filing a compensation claim, specifically:
- the name, surname, and address of the driver at the time of the accident; the name and address of the legal entity owning the vehicle; the name and address of the MTPL insurer that issued the mandatory MTPL insurance contract; the series and number of the insurance contract; the vehicle's registration/identification number;
- submit a compensation claim to the MTPL insurer of the at-fault party or to their own MTPL insurer.
In the case of applying the amicable accident reporting procedure:
– immediately notify the MTPL insurer that issued the mandatory MTPL insurance policy or the BNAA (in the case of holding a "Green Card" insurance certificate) about the accident occurring on the territory of the Republic of Moldova;
– document the circumstances of the accident by completing and signing the "Amicable Accident Report Form";
– record the details of any witnesses, if available;
– take photos and/or videos at the accident scene that include both damaged vehicles, their license plates, the visible damaged areas, and any skid marks or debris present at the scene;
– present the completed and signed copy of the "Amicable Accident Report Form" to the MTPL insurer within two business days from the date of the accident.
– ensure that the MTPL insurer has access to the damaged goods involved in the vehicle accident within five business days.
